Amber Technology Limited (ABN 86 003 231 187) supplies products that are subject to United States and Australian export control laws. This notice applies to all products, software, technology, technical data, and services supplied or referenced by Amber Technology's Defence, Law Enforcement and Security (DLES) division.
1. United States Export Controls (EAR)
Products supplied by Amber Technology Limited that are of U.S. origin, or that incorporate controlled U.S.-origin content or technology, are subject to the U.S. Export Administration Regulations ("EAR", 15 CFR Parts 730-774), administered by the U.S. Department of Commerce, Bureau of Industry and Security (BIS). By accepting delivery, you agree that, without prior authorisation from the U.S. Government where required, you will not export, re-export, or transfer (in-country) the products, directly or indirectly:
(a) to any country or region subject to comprehensive U.S. sanctions or embargoes, or to heightened EAR licensing restrictions, as maintained by BIS and the U.S. Department of the Treasury, Office of Foreign Assets Control (OFAC) from time to time (currently including, among others, Cuba, Iran, North Korea, Russia, Belarus, Syria, and the Crimea, Donetsk, and Luhansk regions of Ukraine);
(b) to any end user whom you know, or have reason to know, will use them in the design, development, or production of nuclear, chemical, or biological weapons, rocket systems, space launch vehicles, sounding rockets, or unmanned aerial vehicle systems capable of a range of at least 300 kilometres; or
(c) to any person or entity prohibited from participating in U.S. export transactions by any agency of the U.S. Government, including persons or entities identified on the BIS Entity List, Denied Persons List, or OFAC Specially Designated Nationals and Blocked Persons List.
Certain radio products, when enabled with AES encryption, are classified under Export Control Classification Number (ECCN) 5A002 and exported in accordance with Section 740.17(b)(2) of the EAR (Licence Exception ENC). Exports, re-exports, or transfers (in-country) of such products to government end users headquartered or located outside the countries listed in Supplement No. 3 to Part 740 of the EAR may require an export licence or other authorisation from the U.S. Department of Commerce. Product-specific classifications are stated in the applicable quotation or documentation and are available on request.

2. United States Export Controls (ITAR)
Certain products, product configurations, software, technical data, and defence services may be subject to the International Traffic in Arms Regulations ("ITAR", 22 CFR Parts 120-130), administered by the U.S. Department of State, Directorate of Defense Trade Controls (DDTC). ITAR-controlled items are subject to separate and additional restrictions on export, re-export, retransfer, and disclosure to foreign persons, and may not be transferred without prior U.S. Government authorisation. Where an item is ITAR-controlled, this will be identified in the applicable quotation, licence, or Technical Assistance Agreement, and any conditions or provisos attaching to the relevant U.S. authorisation will apply.

3. Australian Export Controls
Goods, software, technology, and services supplied by Amber Technology may also be subject to Australian export control laws, including the Defence Trade Controls Act 2012 (Cth) as amended by the Defence Trade Controls Amendment Act 2024 (Cth), the Customs Act 1901 (Cth), the Weapons of Mass Destruction (Prevention of Proliferation) Act 1995 (Cth), and associated regulations. These controls apply to items listed on the Defence and Strategic Goods List (DSGL) and include restrictions on the supply of DSGL technology to foreign persons within Australia, the re-supply of previously exported DSGL items, and the provision of DSGL services to foreign persons outside Australia. Unauthorised export, supply, publication, transfer, brokering, or disclosure may require prior approval from Defence Export Controls (DEC) and may constitute a criminal offence. Recipients are responsible for ensuring compliance with all applicable Australian export control requirements before sharing, transferring, or providing access to controlled goods, software, technology, or technical data.

4. General
